Terms & Conditions

Below are the terms and conditions on which Platinum Health Services Limited (“PHSL”) are to provide Bowen Technique, Reiki, Bioptron Lamp Therapy or Cellulite Therapy or a combination of these services (the “'Services”) to you.  The exact nature of the Services provided to you will depend on what is agreed between you and the practitioner and what is the result of the Health Assessment (see paragraph 1 below).
Before you agree that PHSL will provide Services to you and/or carry out the Health Assessment, please read the terms and conditions below.  If you have questions concerning these please ask your practitioner before entering into a contract with PHSL.

  1. Health Assessment
  2. Purpose of the Health Assessment

Before PHSL will provide any Services it is required that you complete a health assessment (the 'Health Assessment'). The Health Assessment consists of 3 (or sometimes 4) parts:

Your completion of a form: You will be required to complete a form (the 'Health Assessment Form').  This will record details, as stated by yourself, as to the complaint, pain, inflammation etc you are suffering from as well as details of your current state of health, any medical conditions you have and any medication you are taking.

PHSL’s assessment of various health indicators: The practitioner will carry out an assessment including a basic physical examination of you.  (Please note that the practitioner conducting this assessment is not a medical practitioner and as such, this examination should not be relied upon for any other purpose)  PHSL may also to carry out various checks concerning your blood pressure, heart rate, basic metabolic rate and body mass index.  This information will be added to the Health Assessment Form.

Development of a treatment programme: Based on the results of paragraphs 1.1.1 and 1.1.2 above, a discussion will take place on the condition and symptoms you have and discuss a treatment programme using one or more of the Services provided by PHSL.  It may be suggested that you discuss and agree an exercise programme with your nutritionist or medical practitioner, as well as things you can do yourself to assist the treatment PHSL will be providing.  After the treatment programme is agreed, the practitioner will add this information to the Health Assessment Form.

Optional--some initial treatment: It may be appropriate that as part of the Health Assessment some initial treatment is carried out to ease the complaint, pain inflammation etc from which you are suffering.

On completion of the Health Assessment
On completion of the Health Assessment you will be asked to sign the Health Assessment Form to indicate that the information you have provided and what was agreed and stated in the form is recorded accurately.
Length of Health Assessment and cost
The Health Assessment normally takes between 15 to 45 minutes.  PHSL’s charge for this is £30 or set out on the website at www.platinumhealthservices.com or set out in PHSL’s leaflet.
The fee for the Health Assessment will normally always be payable whether or not PHSL will, subsequent to the Health Assessment, be providing any Services to you.

Further points
Please note that after the Health Assessment has been carried out, PHSL may decline to provide any Services to you.  For example, if you suffer from a medical condition which may not benefit from or may be aggravated by the Services provided, or you may need to obtain help or treatment from a medical practitioner.  If this is the case, it will be strongly suggested that you see your medical practitioner.

Performance of the Services
Where the Services to be performed involve treatment this will normally only provided to you:
only after a Health Assessment is carried out; and
in accordance with the programme of treatment specified on the Health Assessment Form.
If there is a (significant) period between a Health Assessment and PHSL providing Services where treatment is provided, the practitioner may:
ask you to confirm in writing that the information you provided on the Health Assessment Form remains accurate and that nothing of significance has changed in your medical condition or complaint or lifestyle which will affect any Services that will be provided; or
ask you to provide a letter from your medical practitioner indicating you can receive treatment from PHSL, or
not provide any Services until you have gone through another Health Assessment.
PHSL will either provide Services on the basis of individual Sessions (see paragraph 4 for explanation) or a series of Sessions.  However, the best results or benefits are usually only possible if a series of Sessions are booked.
It is not possible that any particular result or outcome can be guaranteed as a result of PHSL providing Services to you, but the aim is to provide you with the best possible Services:
by using reasonable care and skill; and
that comply with commonly accepted practices, standards and guidelines of the particular Service being received.
Please be aware that the performance of PHSL’s Services will:
involve the touching and manipulation of parts of your body;
require that the practitioner will require you (depending on the Service), on occasion, to remove at least some of your clothing;
and require that you wear loose-fitting clothing.

Where Services are provided
Normally Services will be provided at your premises.  If you wish PHSL to provide Services at some other location, this can be arranged.  Please ensure that sufficient space is cleared of obstructions for the provision of the Services.

Length of a Session
Services are provided in sessions normally given in 30 – 60 minute slots ('Session(s)').  The actual period of the performance of Services during a Session will normally be approximately 5-10 minutes less.  A few minutes at the beginning of each Session is required to set up, ask you any questions about your condition, any issues or problems etc, allowing you time to disrobe etc.
At any time during a Session if in the practitioner’s opinion it is consider that:
you appear to be unwell or becoming unwell; and/or
are not following reasonable instructions (such as not following instructions intended to protect your, my or another person's safety); and/or
you are behaving or acting unreasonably or are offensive,
then the practitioner may wish to stop the Session and not continue it.

Costs of Sessions and payment

Costs
PHSL’s fee for a Session or a block of Sessions (where ordered by you at the same time) are set out on the website at www.platinumhealthservices.com.

Session overruns
If, at your request, and with the agreement of the practitioner, a Session runs longer then a Session period you will be charged for each 15 minutes that Services are provided to you at the pro-rata rate you are paying for a Session.

Increase in Session costs
If you book a block of Sessions then the fee will remain the same for that block of Sessions if during that period the rate of fees increases.  If you book Sessions one at a time, you will be entering a separate contract at each booking.  In this case the fee for each Session will be that in force at the time of the booking.

Payment
Methods of payment accepted are in cash or by cheque.  All costs are exclusive of VAT as PHSL is not registered for VAT.  Payment for each Session will be by you to the practitioner at the end of that Session.  If you have booked a block of Sessions then payment will be made for all the Sessions booked at the beginning of the first Session.

Travel time
If PHSL provide a Session at your Premises you will not normally be charged an additional fee for travelling to or from a Session (whether or not the location where the Session will take place is chosen by you) although if the Service is provided in the Congestion Charge area, and/ or if parking rates apply, you will be charged appropriately.  If this is required, it will be made clear to you at the time you wish to book a Session.

If you are late for a Session or you cancel

If you are late
If you are late arriving to a Session the Session will start when you arrive.  The Session will continue until its scheduled end.  If you wish the Session to overrun, and it is agreed, then you will be charged for the extra time spent in providing the Services to you, as set out in paragraph 5.2 above.
If in the practitioner’s reasonable opinion it is considered that providing Services will serve no practical value or will be unsafe for you in the time available remaining of the Session then the practitioner may cancel the Session.  You will still be expected to pay for the Session however.

If you cancel
If you have booked a single Session and you cancel with less than 48 hours' notice then you will be required to pay the cost of that Session.  If you cancel a Session when you have booked a block of Sessions, the practitioner will normally rearrange the Session for another time, unless you have cancelled the session with less than 24 hours’ notice.

If PHSL cancel
On occasion PHSL may have to cancel a scheduled Session.  This may occur for of a number of reasons, such as the practitioner is unwell, or a preceding session has overrun or the practitioner cannot reach the location where the scheduled Session is due to take place because of travel problems (traffic jams, etc).  If a cancellation occurs in this situation then PHSL will offer you another scheduled Session without further charge to you.

The practitioner’s qualifications
Your practitioner is a qualified in each type of the Services offered by PHSL and is fully insured.

Transferring booked Sessions
If you have booked (and paid for) Sessions and you would like to allow another person to use the booked Sessions we will have no objection for this to occur as long as the other person undertakes a Health Assessment (in the way outlined under paragraph 1 above).

Your valuables/possessions on PHSL’s premises (if applicable)
Should you receive Services at a premises arranged by PHSL, please use the allocated areas to store your valuables.  While vigilance is kept at all times in such areas, PHSL cannot take responsibility for items lost or stolen if left unsecured.

Limitation of liability to you
PHSL’s liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by the practitioner.  PHSL’s liability for death or personal injury is also subject to certain limitations which are set in paragraph 13.

Limitation and exclusion of liability for personal injury and death
PHSL will compensate you for any loss or damage you may suffer if the practitioner fails to carry out duties imposed by law (including cause of your death or personal injury through professional negligence) unless that failure is attributable to:
a fault of your own;
a third party unconnected with the provision of Services under this contract; or
any events which could not have been foreseen or forestalled even if all reasonable care had been taken.

Contacting one another other
If you wish to send PHSL any notice or letter you should send it to PHSL’s address as registered with Companies House from time to time.  If PHSL intends to send you a letter or notice, the address you have given in the Heath Assessment Form will be used.

Contracts (Rights of Third Parties) Act 1999
For the purposes of the Contracts (Rights of Third Parties) Act 1999 this agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

Disputes
If you are unhappy with any of the Services provided by PHSL, it is hoped that you will discuss any problems or issues with the practitioner in the first instance.  If you wish you may, at any time, take court proceedings.  If so, you must do so within the courts of England and Wales.  This contract is governed and construed by the law of England and Wales.
